Right of Way / Easement Information
For those of you who have co-op equipment on your property, you
are familiar with easements and right-of-way provisions. However,
sometimes it can be easy to forget when you are in the midst of
landscaping.
That is why Consumers Energy wants to remind you to review your
right-of-way contract before you undertake any type of landscaping
or construction near a co-op easement. Disregarding this contract
could allow obstructions that pose a safety risk to both you and
our crews and could mean unnecessary property destruction or modification.
Every easement contract delegates all upkeep and maintenance responsibility
to Consumers Energy, which means you are not liable. Consumers Energy
has an exclusive perpetual right, privilege and easement to construct,
reconstruct, maintain, chemically treat, operate, control, protect,
repair, replace, change the size of or remove power lines, poles,
wires, guys, anchors, underground cables, conduits, pad mounted
transformers, service pedestals, and all equipment, facilities and
appurtenances necessary or incident to the transmission and the
distribution of electrical energy within the confines of a right-of-way.
If you own property and plan on developing, be sure that your general
contractor, builder or developer is aware of these provisions before
they begin construction. Through adequate planning, you can avoid
unnecessary property destruction or modification in the future.
